Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of Viral AI Lab, including our website at viralailab.appand any associated services (collectively, the “Service”). By creating an account, joining our waitlist, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Viral AI Lab provides AI-powered video generation tooling for short-form social media content. You may upload reference video clips and character images, which the Service uses to generate new video outputs through our third-party AI generation provider.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of 18, you may use the Service only with the involvement and consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements.

3. Accounts and SMS authentication

The Service uses phone-based one-time-password (OTP) authentication. By providing your phone number and requesting an OTP, you consent to receive SMS text messages from Viral AI Lab as described below.

4. Acceptable use

You agree NOT to use the Service to:

• Generate content depicting any real, identifiable person without their explicit consent;
• Generate sexually explicit content involving minors or any content that exploits, abuses, or endangers children;
• Generate content intended to defame, harass, threaten, intimidate, impersonate, or deceive any person;
• Generate content that infringes another party's intellectual property, publicity, or privacy rights;
• Generate content that promotes violence, illegal activity, or self-harm;
• Reverse engineer, decompile, scrape, or otherwise abuse the Service or attempt to bypass any technical limitations;
• Resell or redistribute the Service or generated outputs without the rights to do so;
• Use the Service in violation of any applicable law.

We reserve the right to suspend or terminate accounts that violate these rules, with or without notice.

5. Your content

You retain ownership of any inputs you upload, including reference clips, character images, and prompts (“Your Content”). You grant Viral AI Lab a limited, non-exclusive, worldwide, royalty-free license to host, transmit, and process Your Content solely for the purpose of operating and improving the Service.

You represent that you have all rights necessary to upload Your Content and that doing so does not violate any third party's rights.

6. Generated outputs

Subject to applicable law and the terms of our generation provider, you own the video outputs you create through the Service. You are responsible for how you use these outputs. AI-generated content may contain inaccuracies, artifacts, or unintended elements; you should review outputs before using them publicly.

7. Credits and payments

The Service may use a credit-based system to access certain features. Credits are non-refundable, non-transferable, and have no cash value. Credits expire if your account is closed. We may, at our discretion, refund credits for failed generations.

8. Beta and early access

The Service is currently offered in a limited beta. Features may change, be added, or be removed at any time. The Service may experience downtime or instability typical of an early-stage product.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THE QUALITY, ACCURACY, OR AVAILABILITY OF ANY GENERATED OUTPUT.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIRAL AI LAB AND ITS AFFILIATES, OFFICERS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE PRIOR TWELVE MONTHS OR (B) FIFTY U.S. DOLLARS.

11. Indemnification

You agree to indemnify and hold Viral AI Lab harmless from any claims, losses, or damages arising out of (a) Your Content, (b) your use of generated outputs, or (c) your violation of these Terms or applicable law.

12. Termination

You may delete your account at any time by emailing support@viralailab.app. We may suspend or terminate your access to the Service at any time, with or without notice, for any violation of these Terms or for any other reason at our discretion.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected in the “Last updated” date at the top of this page. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

14. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Any dispute arising under or related to these Terms shall be resolved in the state or federal courts located in Delaware, and you consent to the jurisdiction of those courts.
